Counter-Seal US Sink Warranty

1. Limited Warranty

THERE ARE NO EXPRESSED WARRANTIES MADE BY COUNTER-SEAL CORP. ON THE COUNTER-SEAL^® SINK, EXCEPT FOR THE LIMITED WARRANTY AGAINSTDEFECTS IN MATERIAL AND WORKMANSHIP SET OUT BELOW.

Counter-Seal Corp. (the “Company”) warrants to the original consumer purchaser (the “Customer”) that the Counter-Seal^® Sink (the “Product”) will be free from defects in workmanship and material for a period of one (1) year from the date of the initial sale.  Upon the return of a defective Product during this period, the Company will either repair or replace the Product, at its sole option, and subject to the terms of this Limited Warranty at no cost to the Customer.  In addition, the Company warrants the Product to not leak water for the life of the original purchaser; this extended warranty applies to the sink itself and not to any drains, stoppers or plumbing attachments.

To request warranty repairs, the Customer must return the Product to an authorized installer of the Product who provides warranty service.  Installers of the Product are not required to perform warranty repairs or exchanges on behalf of the Company, nor are they authorized to modify this warranty in any way.  Consequently, it is possible that a particular installer may not be able to provide warranty service.  All warranty repair requests must be accompanied by a valid dated sales receipt and a brief description of the alleged warranty problem.  If the Product requires repairs covered by this Limited Warranty, the Company will pay the return shipping charges.  The Product being returned to the Company for warranty service must be pre-authorized by the Company and shipped to the Company at the following address:

2.     Limitation on Warranty

a)  This Warranty only extends to the original consumer purchaser.

b)THIS WARRANTY IS ONLY EFFECTIVE IF THE CUSTOMER HAS:

(i)     ensured that the Product has been properly installed in accordance with the instructions of the Company and that all connected, adjacent and/or associated products and materials are not faulty and have been properly installed.

(ii)    not caused damage intentionally or accidentally or during use; nor any damage to the Product caused by ordinary wear and tear, abuse or tampering with the Product by other than normal use of the Product; or any defects or damage resulting from repairs performed other than by the Company or an Authorized Service Provider.

c)  The Company will not allow claims under this Warranty unless the Customer notifies the Company in writing of the defect before the expiration date of this Warranty and returns all allegedly defective Products for inspection by the Company or its authorized installer.

d)The liability of the Company under this Warranty is limited to the repair or replacement of defective Product as provided herein.  The Company, its employees, directors, officers and agents shall not, under any circumstances, be liable for any personal injuries (including death) to any person (including the Customer or any subsequent purchaser) or for any loss or damage either direct, indirect or consequential (including but not limited to economic loss, loss of profit, loss of production, loss of markets or loss of opportunity), whether to the Product or to any other property of the Customer or subsequent purchaser or user or any other third party, or any other property, whether or not such loss or damage is caused or contributed to or by the ownership, delivery, operation, possession of the Product, or by any defect therein, or by any other cause or reason, whatsoever, including, without limitation, the negligence or default of the Company, its employees, directors, officers or agents.  Some U.S. States do not allow the exclusion or limitation of incidental or consequential damages, so in certain jurisdictions the above limitation or exclusion may not apply.

e)  This Warranty cannot be transferred or assigned by the Customer.

f)  No fabricator, distributor, installer, dealer, representative, agent or employee of the Company has the authority to modify the obligations or limitations of this Warranty.

g)All Warranties implied by law, including Warranties of merchantability and fitness for particular purpose, are limited to one (1) year from the date of purchase of the Product.  Some U.S. States do not allow limitations on the warranty life, so in certain jurisdictions the above limitation or exclusion may not apply.

This Warranty gives you specific legal rights and you may also have other rights which vary from

U.S. State to U.S. State.
